RULES AND REGULATIONS ON TRADEMARKS, SERVICE MARKS, TRADE NAMES AND MARKED OR STAMPED CONTAINERS OF 2023

生效时间：2023.2.14生效后将替代2017年的《商标、服务标识、商号、标记容器条款和规则》1.增加Certification mark证明商标

RULE 101 (c)

“Certification Mark"means any sign,used or intended for use in commerce with the owner's permission by someone other than its owner, to certify regional or other geographic origin,material,mode of manufacture,quality,accuracy, or other characteristics of someone's goods or services, or that the work or labor on goods or services was performed by members of a group or associations;

RULE 400.2

Collective Marks and Certification Marks-An application for registration of a collective or certification mark shall designate the mark as such and shall be accompanied by a copy of the agreement, if any, governing the use of the collective mark or the copy of the standards set by the certifier governing the use of the certification mark, as the case may be.

2.电子通知日视为Mailing Date （原纸质通知邮寄日视为Mailing Date）

RULE 101 (l)

“Mailing Date"means the date it was initially sent through the e-correspondence system or sent to the designated registered e-mail of the applicant/registrant or its agent, as the case may be. In case an office action or issuance has been received both through e-correspondence and e-mail, the reckoning date will be the later date of receipt

3.续展DAU可在商标到期前6个月递交，续展后一年内仍可递交

RULE 206

Renewal DAU.- The Renewal DAU may be filed within the six-month period before the expiration of the registration.

4.商标图样标准(尺寸不大于8*8厘米，不大于2M)

The electronic reproduction should be in .jpg format, must not exceed 8cm x 8cm,and must not be more than two(2) megabytes.

5.对3D marks, color marks, position marks, motion marks, hologram marks 做出较详细要求

6.未注册商标拆分应在注册前提出（原公告前）

7.公告费于申请时缴纳（原审查核准后）

RULE 501

8.大型流行病和突发性公共卫生事件相关的商标申请可申请优先审查（需付费；如药品、疫苗、防护器具、消毒器具、医疗器具、医疗服务等）

RULE 601 (i)

9.如审查员对商标申请有所质疑（实操来看一般是涉嫌抢注）的，审查员有权要求申请人做出解释并提交相关证据证明（可以递交声明书）

RULE 603

10.明确Abandoned商标可在Notice of Abandonment （NOA）发送日起3个月内申请复活（原法条规定为逾期日起3个月内申请复活，但实操中大部分审查员从NOA发送日起算3个月复活截止日）

RULE 611

An abandoned application may be revived within three (3) months from mailing date of the Notice if it is shown to the satisfaction of the Examiner that the delay was due to fraud, accident, mistake or excusable negligence, and upon payment of the required fee; Provided, That there shall be no revival of an abandoned application that had been revived once before on the same issue.

11.声明优先权的商标，应在官方通知日起1年内递交本国注册证（原6个月），且可申请1年延期

RULE 614

12.商标公告后，公众可付费申请查看相关文件，包括已递交的DAU和使用证据

RULE 702

Access to files of pending applications will not be given to anyone without the written authority of the applicant prior to publication for opposition of the mark, trade name, or other mark of ownership. Once the application has been published, access to files including DAU and submitted proofs of use may be made available to the public upon request and payment of the prescribed fees. Information on the name and address of the applicant, name and address of the agent or authorized representative, if any, the mark, the description of the mark, trade name or other mark of ownership, the goods and/or services listed in the application and the corresponding class number/s, the application number and filing date of the application shall be made available on the website of the Office.
